Welcome to Zactimatch, Inc.'s software as a service (SaaS) for comparative analysis. Please read these Terms of Service ("Terms") carefully before using our service. By accessing or using Zactimatch's software, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our software.

By accessing or using the Zactimatch software, you represent that you have read, understood, and agree to be bound by these Terms and to comply with all applicable laws and regulations.

7. Intellectual Property
All content, features, and functionality of the software, including but not limited to information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are the exclusive property of Zactimatch, Inc. and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
8. Fees and Payment
- Access to certain features of the software may require payment of fees. You agree to pay all applicable fees as described on the website in connection with such features.
- Zactimatch, Inc. reserves the right to change its pricing and fees at any time. Any changes will be effective upon posting the revised pricing on the website.
9. Termination
- Zactimatch, Inc. may terminate or suspend your account and access to the software at any time, without prior notice or liability, for any reason, including if you breach these Terms.
- Upon termination, your right to use the software will immediately cease. If you wish to terminate your account, you may simply discontinue using the software.
10. Limitation of Liability
In no event shall Zactimatch, Inc. or its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the software;
- Any unauthorized access to or use of our servers and/or any personal information stored therein;
- Any interruption or cessation of transmission to or from the software;
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the software by any third party;
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the software; and/or
- The defamatory, offensive, or illegal conduct of any third party.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Zactimatch, Inc. is headquartered, without regard to its conflict of law provisions.
12. Changes to Terms
Zactimatch, Inc. reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
